Planning

The Sustainable Planning Act 2009 (SPA), forms the foundation of Queensland’s planning and development legislation. Among other things the SPA establishes the step-by-step process for lodging, assessing and deciding development applications in Queensland. This process is called the “Integrated Development Assessment System” or IDAS.

In conjunction with the SPA, individual Councils have “Planning Schemes” which provide a framework for managing development in a way that advances the purposes of the SPA. Each Planning Scheme identifies assessable and self-assessable development and outcomes sought to be achieved in the local government area.

New Planning Act 2016

New planning legislation commences on 3 July 2017.  It introduces new terminology and other changes to the development assessment system.

In preparation for the implementation of the new planning system Council resolved to propose to make, and subsequently make, an alignment amendment to its scheme incorporating the major and minor and administrative amendments.  The amendment is being prepared.

It will commence on 3 July 2017 which is the commencement date of the Planning Act 2016.

You will be able to download the aligned version of the planning scheme that also incorporates the major and minor and administrative amendments from 3 July 2017.  This new version of the scheme will be fully operational from 3 July 2017.

PUBLIC NOTICE OF ALIGNMENT AMENDMENT TO THE NORTH BURNETT REGIONAL PLANNING SCHEME MADE UNDER THE ALIGNMENT AMENDMENT RULES AND THE PLANNING ACT 2016, SECTION 293

Notice is hereby given that on 17 May 2017 the North Burnett Regional Council made the alignment amendment incorporating all scheme amendments to date, to the North Burnett Regional Planning Scheme 2014 under the Alignment Amendment Rules and section 293 of the Planning Act 2016 (the alignment amendment). The alignment amendment will commence on 3 July 2017.

The alignment amendment has the purpose and general effect of—

  • replacing terminology and language from soon-to-be-repealed legislation with terminology consistent with the Planning Act 2016 including but not limited to categories of development and assessment;
  • replacing definitions for consistency with QPP 4.0.

Charges Resolution (previously Adopted Infrastructure Charges Resolution)

The State government, through its State Planning Regulatory Provision (adopted charges) (SPRP), regulates the maximum charges local governments can apply to new development.  Each local government makes its own Charges Resolution detailing the circumstances in which infrastructure charges apply to development and the level of charges for each development category.

Council levies infrastructure charges during the development assessment process by issuing an Infrastructure Charges Notice. Charges apply where development for reconfiguring a lot or making a material change of use generates additional demand on trunk infrastructure networks.  Money or land collected through this process contribute to the delivery of essential trunk infrastructure to service new development.

On 6 October 2015, Council resolved to adopt ‘Charges Resolution (No 2) 2015’. CR (No.2) 2015 is effective from 7 October 2015 and is available here.

North Burnett Infrastructure Charges No 2 2015

CR (No.2) 2015 will apply to new applications lodged from 7 October 2015. Any application properly made prior to this date will continue to be assessed under AICR 1 of 2015.

Flood Studies


Development Applications

A Planning Scheme, amongst other things, identifies the zoning of a property and will identify assessable, self-assessable or exempt developments. Developments that are assessable (Code or Impact) will require a development application to be submitted to Council for assessment by Council Planning staff. The type of development that applications are required for include:-

  • Reconfiguring of a Lot
    Generally means subdivision and/or boundary realignments
  • Material Change of Use
    Generally means the start of a new use, re-establishment of a use that has been abandoned or changing the intensity or scale of the use.
  • Operational Works
    Generally means, undertaking the actual works associated with any land use/subdivision, etc on sites, eg. earthworks (excavating or filling), clearing vegetation, including vegetation to which the Vegetation Management Act applies, etc.

Prior to submitting an application it is strongly suggested that you contact the relevant Development Services Sections. This may take the form of a phone discussion, or for more involved proposals, a pre-lodgement meeting.

An application usually consists of the appropriate Application Forms, plans, town planning report, engineering reports and the relevant application fee.

Once the relevant information is collated you may lodge these details together with the application fees to any of the Council’s regional Offices.

Building

A Building Development Application is required to be submitted to a Building Certifier for most building works undertaken within the Council area. An application usually consists of the appropriate Application Forms, plans, reports and the relevant application fee.

You may lodge your application at any of Councils regional offices.

Building Inspection requests must be received 48 hours prior to the time required.

Amenity and Aesthetics

Council adopted an Amenity and Aesthetics Policy at its Policy and Standing Committee Meeting held on 4 November 2015.  The objective of the Policy is to set Council’s position with regard to particular types of Class 1a and Class 10 development, particularly where these types of developments may have an extremely adverse effect on the amenity, likely amenity, or may be in conflict with the character of a North Burnett locality.  Section 2 of the Policy provides a list of various building works that may fall into these categories.

Plumbing

A Plumbing Application is required to be submitted to Council for most plumbing and drainage work carried out on/to domestic and/or commercial buildings/properties. Plumbing and Drainage, amongst other things, can consist of new or additional plumbing fixtures (eg. toilets, basins, baths).

An application usually consists of the appropriate Application Forms, plans, reports and the relevant application fee.

Once the relevant information is collated you may lodge these details together with the application fees at any of Council’s Regional Offices.

Plumbing Inspection requests must be received 48 hours prior to the time required.
